Terms of Service

1. Definitions

"Tag" means a physical NFC/QR product sold by FoundSOS.

"Owner" means a registered user who has activated a Tag. "Finder" means any visitor who scans a Tag.

"Premium" means our paid subscription described in §6.

2. Account & Eligibility

You must be at least 16 years old to create an account. You are responsible for keeping your credentials secret and for all activity on your account.

We may suspend or terminate accounts that violate these Terms, applicable law, or that pose a security risk.

3. Tag Activation & Ownership

Each Tag has a unique 8-character activation code. Activation binds the Tag to your account. You may transfer or deactivate a Tag at any time from your dashboard.

We are not responsible for items lost, stolen or damaged. Tags are an aid to recovery, not a guarantee.

4. Acceptable Use

You may not upload illegal, infringing, hateful, or sexually explicit content; impersonate others; harvest data; or use the Service to harass any person.

Finders who contact Owners must use the chat only for purposes related to returning the item.

5. User Content & Licence

You retain ownership of content you upload (photos, descriptions, medical info). You grant us a limited, non-exclusive licence to host and display that content as required to operate the Service.

You confirm you have all rights necessary to upload that content and that it does not violate any law or third-party right.

6. Premium Subscription

Premium costs €2.99 per month or €29.99 per year. The first 30 days after activating your first Tag are free.

Subscriptions renew automatically until cancelled. You can cancel anytime from /app/subscription; cancellation takes effect at the end of the current billing period.

Prices include applicable VAT where required. We may change pricing with at least 30 days' notice; existing subscriptions keep the previous price until next renewal.

7. Right of Withdrawal (EU)

Consumers in the EU have 14 days to withdraw from a distance contract without giving any reason.

For digital services that start immediately at your request, you expressly waive the right of withdrawal once the service begins, and acknowledge you lose that right upon performance.

For physical Tags, the 14-day return window starts the day you receive the item; see /legal/refund for the procedure and the model withdrawal form.

8. Disclaimer & Liability

The Service is provided 'as is'. To the maximum extent permitted by law, we exclude warranties of merchantability or fitness for a particular purpose.

Our aggregate liability for any claim is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) €100. Nothing in these Terms limits liability for gross negligence, wilful misconduct, death or personal injury, or any liability that cannot be excluded by law.

9. Suspension & Termination

You may close your account anytime from the dashboard. We will delete or anonymise personal data per the Privacy Policy.

We may suspend the Service for maintenance or terminate accounts for serious or repeated breach of these Terms.

10. Changes

We may update these Terms. We will notify you by email or in-app at least 14 days before material changes take effect. Continued use after that date means acceptance.

11. Governing Law & Disputes

These Terms are governed by the laws of Bulgaria and applicable EU law. Mandatory consumer protection laws of your country of residence still apply.
